JOMEX MEDIATERMS AND CONDITIONSAdvertising ConditionsPublisher is Jomex Media. Advertisers and/or advertising agency for publication in newsPinoy agree and comply with the conditions below:1. All ads accepted for publication in newsPinoy is subject to conditions set in our advertising rates and rules applicable to advertising.All ads are subject to Publisher’s approval. The Publisher can refuse at any time to publish any advertisement without giving any reason. Should the advertisement be refused, the Advertiser shall incur no charges. The Publisher will not be responsible for any loss of any nature from the said refusal or failure to publish.2. It is the responsibility of the Advertiser to notify the Publisher of any error as soon as it appears. The Publisher accepts no responsibility for any error unless notified. The Advertiser shall provide the Publisher a written confirmation of the corrections or copy before normal deadline.3. The Publisher may amend any advertisement without prior consultation to the Advertiser, if the advertisement is considered and perceived by the Publisher to be offensive, and/or in violation of any law in Australia or any state whether it is civil law or criminal law, is considered to be defamatory, and/or in contempt of court or parliament, and/or if it would attract legal proceedings of any kind. Therefore, the Publisher will not be responsible for any loss as a result of such amendment. The Publisher also has no obligation to Advertiser to amend, review or approve the advertisement. Moreover, such review, amendment, or approval by the Publisher shall not impact or cause Advertiser’s liability for the content of the advertisement. Should the Publisher amend the advertisement, the price that is agreed will not be reduced.4. The Publisher has the right to (a) position any accepted advertisement anywhere within the same section, page or placement at its own discretion, (b) change the date of publication of the advertisement, without prior consultation to the Advertiser, unless a specific section, page or placement or date has been previously agreed. Again, the Publisher is not responsible for any loss incurred as a result of these changes.5. The Publisher has the right to defer printing issue/s of newsPinoy resulting from the low quantity of advertisement and other possible causes. As newsPinoy is a free monthly Filipino newspaper, it relies on advertisement to sustain it operations, including but not limited to marketing, administration and its ability to generate monies to pay the printing press. In this case, the rate of agreed advertisement is not reduced and will be placed in the following issue once the Publisher deems it has enough monies to print the next issue. The Advertiser will be notified of any non-issue of newsPinoy. The Publisher is not liable and responsible for any loss arising from non printing of issue/s of newsPinoy.6. The Publisher is not liable to the Advertiser for any loss of any nature from the total failure of the Publisher to publish any ad in any form described by the Advertiser. In any case the Advertiser shall incur no cost. Any rate will be reduced according to the circumstances.7. Advertisements that are ordered and paid by the Advertiser are understood to be used within one year it is ordered and approved by the Publisher. These rates are subject to any changes. Should any Advertiser fail to use that money ordered within a year, the Publisher has the right to amend the advertising rate and apply the rate to its corresponding section, page or any space used.8. The Publisher has the authority to amend these conditions at any time. Any amendment shall be included with the advertising rates. The amendment shall automatically apply to all advertising received on the date of such amendment. Any pre-existing agreement between the Publisher and Advertiser will not be affected.IndemnityOn or by lodging material including electronic material or data with Publisher for publication or authorizing or approving of the publication of any material by Publisher, the Advertiser agrees to indemnify Publisher and any agents against all claims, demands, proceedings, any costs (including solicitors and own client costs), expenses, damages awards, judgements and any other liability whatsoever arising wholly or partially, directly or indirectly, from or in connection with the publication of the material.Without limiting the generality of the above, the Advertiser agrees to indemnify Publisher and any of its agents against any claims arising from or allegations of : defamation, libel, slander of title; infringement of copyright; infringement of trademarks or names of publications titles; unfair competition; breach of trade practices, privacy or fair trading legislation; and violation of rights of privacy or confidential information or licenses or royalty or other intellectual property rights.
